EPR France vs Germany vs Spain: Which System Is Toughest for Foreign Sellers?

Three countries, three very different systems

France, Germany, and Spain are the three largest e-commerce markets in continental Europe. Most sellers targeting the EU sell in at least two of these three. Yet their EPR systems differ dramatically in scope, complexity, enforcement intensity, and cost.

Understanding these differences is critical for budgeting, prioritising compliance efforts, and choosing the right service providers in each market.

Scope: France is the most comprehensive

France operates 19 active EPR categories covering packaging, electronics, batteries, textiles, furniture, construction materials, toys, sporting goods, DIY articles, chemicals, tyres, medicines, tobacco, vehicles, and more. Every consumer product sold in France triggers at least one EPR category (packaging), and most trigger two or more.

Germany focuses primarily on packaging (VerpackG), WEEE (ElektroG), and batteries (BattG). The total number of EPR categories is approximately 6. Germany does not have textile, furniture, toy, or sporting goods EPR at the national level.

Spain has approximately 8 EPR categories including packaging (Ecoembes), WEEE, batteries, tyres, and oils. Spain is expanding its system but remains less comprehensive than France.

For a seller of electronics: France requires packaging plus WEEE plus battery EPR (3 registrations). Germany requires packaging plus WEEE plus battery EPR (3 registrations plus LUCID). Spain requires packaging plus WEEE plus battery EPR (3 registrations).

For a seller of furniture: France requires packaging plus furniture EPR. Germany requires only packaging EPR. Spain requires packaging EPR and is developing furniture EPR.

Registration complexity

France: register with each eco-organisation through a mandataire. One IDU per category from ADEME. Straightforward once you have a mandataire.

Germany: dual registration required. First register with LUCID central register (mandatory). Then contract with a dual system operator for packaging. For WEEE, register with stiftung EAR. The dual registration catches many foreign sellers off guard.

Spain: register with Ecoembes for packaging and with the RPP product register. Relatively straightforward but requires Spanish-language documentation.

Enforcement intensity and penalties

Germany has the strictest enforcement with fines up to 200,000 euros for non-registration with LUCID. Germany also allows competitors to issue cease-and-desist letters (Abmahnung) against non-registered sellers, creating private enforcement in addition to public authorities.

France has fines up to 7,500 euros per unit or tonne plus 30,000 euros for missing IDU, plus daily penalties up to 20,000 euros. France is intensifying enforcement through data cross-referencing and the new contribution d'office mechanism.

Spain has proportional fines based on undeclared volumes. Enforcement is less aggressive than France or Germany but is strengthening.

Cost comparison for a typical seller

Small electronics seller placing 5,000 units per year. France total: approximately 1,200 euros per year. Germany total: approximately 800 euros per year. Spain total: approximately 500 euros per year. Combined 3 countries: approximately 2,500 euros per year plus mandataire or service provider fees.

The cost ranking is generally France most expensive, Germany middle, Spain least expensive for equivalent volumes. However, German penalties for non-compliance are the highest in Europe, making the cost of non-compliance far greater there.

The trend toward convergence

The PPWR will gradually harmonise packaging design requirements across the EU, making it easier for companies to use a single packaging design for all markets. However, national EPR systems will remain separate. The practical decision framework for multi-country sellers

If you sell in only one EU country, register there. If you sell in 2 to 3 countries, a mandataire in each country or a multi-country coordinator is the most efficient approach. If you sell in 4 or more countries, centralised coordination is almost always cheaper than managing individual providers.

The PPWR (EU 2025/40) will progressively harmonise packaging design requirements across all EU countries starting in 2026 to 2030. This means one packaging design will eventually satisfy all markets. However, the EPR registration and payment systems remain national. Five countries equals five registrations even after PPWR harmonisation.
